Two State Center Workers Charged With Disabled Man’s Death

June 28, 2011

When we are no longer capable of taking care of a loved one, we entrust specialized living facilities to care for them and to show genuine concern for the patient’s well being. When these basic needs stop being met, the situation can quickly deteriorate. Such is the case of two workers from a Houston, Texas, state center who were arrested and charged with involvement in the death of a patient at the facility.

According to Channel 25 News, the pair was arrested yesterday by the Fort Bend County Sheriff’s Office in connection with the October 8 death of a disabled man at the Richmond State Supported Living Center. The indictment states one of the charged individuals allegedly struck the man in the abdomen with an unknown object and, then, found him five hours later not breathing. The other person was the nurse on duty at the time of the incident and is accused of reporting the disabled man to have been in good health when an autopsy showed he was dying from blunt force trauma. They have been charged with first-degree injury to a disabled person.

With the number of incidents of nursing home abuse going up every year, many people do not understand the many different types of abuse that exist and what can be done to stop it. The Texas Nursing Home Abuse Attorneys with Daniel Stark Injury Lawyers can answer these and any other questions you may have regarding the care of your loved one.

Texas Insurance Department Issues $70,000 In Fines

June 21, 2011

The Texas Department of Insurance Division of Workers’ Compensation (TDI-DWC) took final disciplinary action against several companies in May resulting in more than $70,000 in fines. The TDI-DWC press release announced the rulings against several insurance companies and doctors’ offices related to violations of the Texas Labor Code and rules promulgated by the Commissioner of Workers’ Compensation.

Indemnity Insurance Company of North America of Philadelphia, Pennsylvania, suffered the largest fine with a $15,500 blow to their wallet. They were fined due to failure to pay an injured employee in a timely manner and failure to comply with an earlier order by the department to pay up.

Texas Hospital Insurance Exchange of Austin was fined $5,000 for failure to submit medical bill and payment data in a timely manner.

Zurich American Insurance Company paid a whopping combined total of $19,000 for a laundry list of violations including failure to submit medical bill and payment data in a timely manner, failure to pay an injured employee in a timely manner, failure to comply with orders from the TDI-DWC commissioner, and failure to sufficiently explain reasons for the deduction or denial of payment for health care services.

Insurance companies are for profit businesses that don’t always have a client’s best interest at heart. The Texas Personal Injury Attorneys with Daniel Stark Injury Lawyers have experience handling insurance companies and may be able to help you with your case.

Tow Truck Accident Kills Young Girl, Injures Mother And Sister

June 14, 2011

An accident on the Sam Rayburn Toll-way in Denton County, involving a tow truck and a disabled car, killed a young girl and seriously injured her mother and sister late last Wednesday.

According to The Dallas Morning News, around 9:30 PM, the mother was driving a silver Dodge Sedan southbound on the toll-way, near Spring Creek Parkway, when the car began to have mechanical problems. She pulled the car into the center lane of the three-lane parkway when the tow truck suddenly struck her from behind. The impact of the crash killed the girl who had just turned nine-years-old two weeks earlier. The mother and sister of the young girl sustained non-life threatening injuries, and were transported to the local hospital to be treated.

The article states that the speed limit is 55 miles per hour along this stretch of road that is notoriously dim from poor spacing in the streetlights. Large vehicles, like a tow truck, weigh significantly more than a small car. This means it will take them longer to slow down and will have an impact sometimes ten times more intense than that of a small sedan. This is why accidents involving large trucks are often times so deadly.

If you or someone you know has been injured in a truck related accident, contacting an experienced Texas Truck Accident Attorney with Daniel Stark Injury Lawyers can help ensure your rights are protected, and all appropriate parties are held accountable

Two Dead After Bryan-College Station Airplane Crash

June 7, 2011

Two people died after a small engine aircraft crashed on May 28, 2011, outside of Bryan-College Station, Texas. Velozia Air reports that the Rockwell Commander 112 left Dallas at 7:23 PM en route to Galveston, Texas. About halfway into the trip, air traffic control received a call from the pilot declaring a fuel emergency, at which point the plane was diverted to an airfield near Bryan-College Station. There were two other air fields that were closer, but for some unknown reason, the pilot choose to go to this particular site. The plane unfortunately did not make it to its destination and crashed in the parking lot of an apartment complex, killing both the pilot and the plane’s passenger.

The plane was severely damaged with the fuselage crushed into the wings and the planes instrument panels pushed through the seats. An investigation into the cause of the accident is ongoing, but it is speculated from conversations the pilot had with air traffic control that a fuel leak developed which led to the crash.

The aftermath of accidents like these are a huge mess to clean up with insurance companies battling with property owners and the victim’s families on what is fair compensation for their loss. Texas Personal Injury Lawyers can fight for victim’s rights, to ensure they get the compensation they deserve.
